Police in Kentucky have reported that two Harrodsburg residents were taken into custody on drug possession charges during the early morning hours of March 31. After being processed, the two men, who are 31 and 44 years of age, were transported to a detention facility in Boyle County. A cash bond of $5,000 was set for the 31-year-old man and a $7,500 10-percent bond was set for the 44-year-old.
The men were taken into custody during a narcotics investigation that was being conducted by deputies from the Mercer County Sheriff’s Office. Searches performed during the investigation are said to have yielded quantities of methamphetamine, heroin and cocaine. Deputies say that they also recovered drug paraphernalia including syringes and scales.
A press release issued by the sheriff’s office subsequent to the arrests indicated that the investigation was ongoing and further charges were expected to be filed. It implied that the charges would involve different individuals. The 44-year-old man is charged with three counts of first-degree drug possession and one count of possessing drug paraphernalia. The 44-year-old man is charged with one count of first-degree drug possession and one count of possessing drug paraphernalia.
Those convicted of first-degree drug possession in Kentucky face severe penalties, but proving such charges beyond a reasonable doubt can sometimes be a challenge for prosecutors. The Fourth Amendment protects the public from unreasonable searches and seizures, and police officers must generally obtain search warrants before conducting searches. Criminal defense attorneys may scrutinize search warrants closely, and they may seek to have any drugs recovered during searches excluded if police officers appear to have strayed beyond what they are legally permitted to do.
